Welcome to 5StarsDentistsBooking by AMAYS (“Company,” “we,” “our,” or “us,” operated by **AMAYS Money Properties LLC**). These Terms of Use (“Terms”) govern your access to and use of our website, platform, and related services (collectively, the “Services”). By using our Services, whether as a patient, a provider, or a referrer, you agree to these Terms. If you do not agree, please do not use the Services.

1. What We Do (and Do Not Do)

• We provide a neutral online booking tool that helps patients connect with licensed dental professionals ("Practices").
• We **do not practice dentistry or medicine**, and we do not influence, control, or participate in clinical decisions.
• We do not set fees, process insurance claims, or determine payment terms between patients and providers.
• We reserve the right to update, modify, or discontinue any part of the Services at any time.

2. Eligibility and Authority

To use the Services, you must:

• Be at least **18 years old** if you are a patient or a referrer.
• Be properly licensed and authorized if you are a provider.
• Agree to provide accurate and truthful information.
• Use the Services only for lawful purposes.

We may restrict or terminate access if these conditions are not met.

3. Data Privacy and Communications

Your use of the Services is subject to our **Privacy Policy**, available at [Insert Link to Privacy Policy].

A. Data Handling and PHI

• By using the Services, you acknowledge that certain data collected for appointment booking (including insurance information and questionnaire answers) may constitute **Protected Health Information (PHI)**.
• You consent to our collection, use, and disclosure of your Personal Information, including PHI, as described in the Privacy Policy, specifically acknowledging our role as a **Business Associate** of the healthcare providers (Practices) in compliance with **HIPAA**.

B. Electronic and Telephonic Communications

By using the Services, you agree that we may communicate with you through:

• Email, phone, **SMS (text messaging)**, or other electronic means.
• For matters related to scheduling, account support, confirmations, updates, and notices required by law.
• **SMS Communications:** If you provide your mobile number, you agree to the **SMS Terms of Service** detailed in **Section 9** of our Privacy Policy, including consent to receive promotional and informational messages and the methods for opting out (reply **STOP**).

These communications are considered part of the Services.

4. User Responsibilities and Conduct

When using the Services, all users (patients, providers, and referrers) agree to:

• Provide accurate information and keep account details current.
• Not misuse the platform (e.g., spam, fraud, unauthorized access).
• Respect all applicable laws and regulations.
• Patients are solely responsible for their personal healthcare decisions and payments to providers.
• Providers are solely responsible for their professional services, patient care, and compliance with all legal and licensing requirements.
• Referrers must comply with the terms set out in the Referral Program Policy (see Section 6).

5. Additional Terms and Policies

In some cases, users may be subject to additional agreements and policies, which form a part of these Terms:

• Providers may be subject to a separate **Provider Services Agreement**.
• Payment terms (including fees for providers) are described in our **Billing Policy**.
• Referrers are governed by the **Referral Program Policy**.
• Your data handling is governed by our **Privacy Policy**.

If there is a conflict between these Terms and any of the Additional Terms or Policies, the Additional Terms or Policies will govern.

6. Referral Program Policy

By registering as a Referrer, you agree to the terms and conditions outlined in the separate **Referral Program Policy**. This policy governs eligibility, reward structure, payment terms, and all rules regarding the use of the Referrer Portal. Any reward payment is strictly contingent upon the terms defined in the Referral Program Policy.

7. Intellectual Property

• All platform content, branding, and technology remain the property of **5StarsDentistsBooking by AMAYS**.
• You may use the Services only for their intended purpose.

8. Limitation of Liability

• We are **not responsible** for the quality, safety, or outcome of any dental or medical services provided.
• We are **not liable** for disputes between patients and providers.
• To the fullest extent allowed by law, our liability to you for any claim related to the Services is limited to the greater of: (a) the amount you paid us for Services in the past 12 months, or (b) **$100**.

9. Termination

We may suspend or terminate access to the Services at our discretion, including for violations of these Terms or misuse of the platform.

10. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the **State of New York**.
• Any disputes will be resolved through **binding arbitration**, unless prohibited by law.

11. Updates to Terms

We may update these Terms from time to time. If changes are material, we will provide notice (such as posting on our site or emailing users). Continued use of the Services means you accept the updated Terms.
